HC rule nisi against 21 persons

A High Court (HC) division bench yesterday issued rule-nisi on 21 persons including Deputy Commissioner (DC), Police Super (SP), the Upazila Nirbahi Officer (UNO) of Brammanbaria, and Officer-in-charge (OC) of Kotowali model thana to explain within two weeks as to why punishment to be ordered to them for not complying with an order of HC Division.
The HC branch comprising Justice AHM Shamsuddin Chowdhury and Jahangir Hossain taking cognisance of a writ petition filed by Rakib Miah Chowdhury, President of Chatok Lime Factory Owners Association.
The HC had, earlier on 8/12/2011 ordered 11 persons including the DC, SP of Brammanbaria to closed down illegal lime factories at village Bakai of the district.
But, even after receiving the HC order, they did not take any specific step in this regard.
As a result, legal notice was served on 24 persons including 20 owners of illegal lime factories, the DC and SP of Brammanbaria, the UNO and the OC for violating the HC order.
Upon receipt the notice, three owners of the illegal factories closed down their establishments. But other refrained from taking any measure.
During the hearing, of a contempt of Court petition filed on behalf of Rakib Miah Chowdhury, Justice Md Asfaqul Islam and Justice Md Asraful Kamal issued the rule upon 21 persons including 17 factory owners, the DC, and the SP of Brammanbaria.
Barrister Mainul Husein, senior advocate of the Supreme Court did the hearing on behalf of the petitioner. Md Moniruzzaman and Bipul Bagmar assisted him.
